By accessing or using CR8 Ai (a product of ZOD Media Ltd.), you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, do not use the platform.

2. User Responsibilities

• Accuracy of Inputs: You are solely responsible for the legality and accuracy of the sketches, prompts, and product ideas you submit.
• Appropriate Use: You agree not to misuse ZOD AI for unlawful, defamatory, infringing, or malicious purposes.
• Use at Your Own Risk: All outputs are for prototyping, informational, or planning purposes only and should not be treated as final production specifications without independent verification.

3. Data Usage & AI Training

• User Content License: By uploading any material to CR8 Ai, you grant us a non-exclusive, worldwide, royalty-free license to use, modify, and incorporate such data into our tools and training datasets, including for commercial purposes.
• Scraped and Aggregated Content: CR8 Ai may present content or recommendations inspired by or derived from public sources or third-party websites. We do not claim ownership over such external content and do not guarantee its accuracy, lawfulness, or availability.
• No Affiliation or Endorsement: The appearance of third-party content (product designs, inspiration, manufacturer suggestions, etc.) does not imply any formal relationship, endorsement, or approval from the original source.
• Safe Harbor Clause: You agree that CR8 Ai is not liable for the use of AI-generated content inspired by publicly accessible data or third-party content. If you believe your rights are infringed, please notify us for review.

4. Intellectual Property

• Ownership: All algorithms, AI-generated content, design templates, system interfaces, and proprietary tools are owned by ZOD Media Ltd or its licensors.
• Usage Restrictions: You may not copy, reverse-engineer, resell, or train models using CR8 Ai’s output without explicit written permission.
• Model Outputs: Users retain rights to their original uploaded content. However, ZOD Media retains rights to all AI-generated outputs, including those based on user inputs, unless a custom licensing agreement is in place.

5. Third-Party Manufacturers

• Independent Engagement: CR8 Ai facilitates discovery of third-party manufacturers. These are suggestions, not endorsements.
• No Guarantee: We do not guarantee delivery timelines, quality control, pricing, or legal compliance of third-party services. All dealings are strictly between the user and the selected manufacturer.
• Location-Based Pricing Disclaimer: Any geographic manufacturing location on pricing is informational only and subject to change.

6. Pricing & Estimation Tools

• Indicative Nature: All costing, MOQ, and BOM estimates are indicative only. Prices may vary based on supplier terms, shipping, and material availability.
• No Commercial Liability: CR8 Ai is not responsible for losses or business decisions made based on these estimates.

7. Limitation of Liability

To the maximum extent permitted by law:

• CR8 Ai shall not be liable for any indirect, incidental, consequential, punitive, or special damages, including loss of profit, revenue, data, or business opportunities
• Our total liability, under any circumstance, shall not exceed the fees (if any) paid by you for using CR8 Ai in the three months prior to the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless CR8 Ai Ltd and its affiliates, officers, and employees from and against any claims, damages, losses, or legal costs arising from:

• Your use of the platform
• Your uploaded content or product ideas
• Third-party disputes related to data, content, or manufacturing
• Any breach of these Terms

9. Termination

CR8 Ai may suspend or terminate access to the platform at any time, with or without notice, for conduct believed to be in violation of these Terms or misuse of the platform.

10. Dispute Resolution & Governing Law

These Terms shall be governed by the laws of England and Wales. Any disputes will be subject to confidential arbitration in London unless otherwise required by applicable consumer law.
